Privacy Notice

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”) and its Regulations (the “Regulations”), this privacy policy (this “Privacy Policy”) describes how TC LATIN AMERICA PARTNERS and its affiliates (collectively, “TC LATAM”) collect, handle, use, and share the information we collect through websites owned or operated by companies within TC LATAM,  including https://tclatam.com (our “Site”). “You” means any person, company, or legal entity that accesses and uses the Site, as well as any officers, directors, partners, personnel, employees, agents, or contractors who use the Site through that company or legal entity, whether authorized or unauthorized. “We” or “us” refers to TC LATAM.

 

This Privacy Policy should be read in conjunction with any other policies, terms and conditions applicable between you and TC LATAM. Your use of the Site indicates your agreement and consent to the use of your information in accordance with the practices described in this Privacy Policy. Please do not use the Site if you do not agree to this Privacy Policy.

 

Updates to this Policy. We reserve the right to change all or part of this Privacy Policy at any time. If we make a material change to the Privacy Policy, we will post a notice on our Site when we post the revised Policy. Your continued use of the Site after a change is made constitutes your agreement to the revised Privacy Policy.

 

Collection of Your Information. As a result of the business relationships that may exist between your client (“Your Information”) and TC LATAM, information relating to you and/or your company and/or related persons may be collected. Our records consist of information provided directly by you, information available in public registries and information provided by third parties who have expressly stated that they have authorization to do so, either in order to analyze a possible commercial transaction with TC LATAM, a possible contractual relationship of any nature, and/or to comply with any legal provision to which TC LATAM is subject.  whether in Mexico and/or any other jurisdiction. The foregoing includes that the personal data that works in TC LATAM’s databases may be transferred or shared to any of its affiliated companies and/or subsidiaries, and even national or foreign third parties; unless you, as the owner, expressly express your opposition in terms of “Law”.

 

We collect information from you when you voluntarily provide it to us through the Site, as well as automatically through your visits to the Site. The information that is collected may include: first and last name, email address, phone number, mailing address, login credentials, password, response to a security question, whether you are a financial advisor or broker-dealer, the name of your financial advisory firm (if applicable), the IP address of your computer, the Internet browser and operating system you are using,  the length of time you spend browsing the pages of the Site and the websites you access immediately before and after your visit to the Site.

 

You may voluntarily provide Your Information through the Site in a number of ways, including: (a) when you log in to your account or make updates to your account information; (b) when you complete a form on the Site; and (c) when you contact us to request information. As mentioned, the Site also automatically collects Your Information related to Your use of the Site. We may use “cookies” (small text files located in your device’s memory) or other similar technologies to retain information about you and your use of the Site, and we may use third parties to assist us in the collection of Your Information. These technologies may automatically collect information related to the hardware and software you use to visit the Site and the pages you have visited. We may link Your Information automatically collected by the Site to Your Information that we collect from other sources or that you provide to us. We may use Your Information that has been collected automatically to help authenticate you, store and recognize your user settings and attributes, facilitate navigation of the Site, and personalize the information available on the Site to you. You are free to refuse our cookies if your browser allows you to disable them, but if you do so, some parts of the Site may not function properly.

 

Use of Your Information. We may use Your Information to provide you with information and services, send you notices (e.g., in the form of e-mails or mailings), and respond to your requests. We may also use Your Information to improve the operation of the Site and the services and information offered, to provide you with personalized features, in our marketing and promotional efforts on the Site and elsewhere, in statistical analysis of Site usage (both individually and in the aggregate), to update and improve our records, maintain and improve the Site,  and for other purposes identified in the relevant sections of the Site where Your Information is collected. We may also use Your Information to contact you about us or the Site, resolve disputes, troubleshoot problems, and enforce and investigate your compliance with our agreements with you, including our Terms of Use and this Privacy Policy. We may also use, compile, and analyze Your Information to understand your use of the Site, how many people visit the Site, which sections of the Site are most visited, and trends in user behavior.

 

Sharing Your Information. We may share Your Information with affiliated entities within TC LATAM. We may also share Your Information with certain unaffiliated third parties in some circumstances, including the following:

 

  • Vendors and Suppliers. We may share Your Information with vendors, non-affiliated vendors, authorized representatives, service providers, and agents to assist us in maintaining the Site, storing Your Information, fulfilling your requests, or providing services or support for TC LATAM’s business.

 

  • Government Agencies/Law Enforcement. In certain circumstances, TC LATAM may be called upon to disclose Your Information in response to a court order, subpoena, search warrant, law, or regulation. TC LATAM plans to cooperate in response to such requests, taking appropriate steps to ensure that the requesting party understands the sensitive nature of Your Information that they may receive. TC LATAM also reserves the right to disclose Your Information in the event that we have reason to believe that someone is causing or threatening to cause harm to or interference with our rights or property, the rights or property of others, the operation of the Site, any user of the Site, or any other person who could be harmed by such activities,  or if someone is otherwise engaging in behavior that is illegal or harmful to others.

 

  • Corporate Transactions. If TC LATAM sells all or a portion of its business, makes a sale or transfer of assets, or is otherwise involved in a merger, business transfer, or other type of liquidity event, TC LATAM may, in its sole discretion, transfer, sell, or assign Your Information to the acquiring entity as part of or in connection with that transaction. In such transfer, sale, assignment, or other liquidity event, the assignee, assignee, successor, or acquiring party may use Your Information in accordance with this Privacy Policy or as permitted by applicable law or regulation.



We may also share anonymous and aggregated data relating to our users with third-party analytics services, business partners, and others interested in how the Site is used. We do not share Your Information with unrelated third parties for our own direct marketing purposes.

Safety. With the exception of the provisions of Article 37 of the Law, TC LATAM is responsible for granting confidential treatment to the personal data it obtains from third parties, whether it has been directly provided by you or obtained by various means, and will take the necessary and sufficient security measures to guarantee legitimate handling,  controlled and informed of any personal data of such third parties, by their staff, employees, dependents, consultants, associates, affiliates, subsidiaries or any other person with whom they have a relationship and who may have access to such personal data. We use reasonable efforts to maintain physical, electronic, and procedural safeguards in order to protect the confidentiality and integrity of Your Information. However, no security system is foolproof and we cannot completely eliminate security risks with respect to Your Information. We recommend that you do not send us any of Your Information through unsecured methods of correspondence, including public electronic communication channels, such as Internet email, which are generally not secure. 

 

Other Sites or Services. The Site may contain links to other websites or allow you to use or access third-party services. We are not responsible for the privacy practices of any other website or other service provider.

 

The information you submit to those websites and service providers is subject to the privacy policies of those other websites and service providers, not this Privacy Policy. We encourage you to review the privacy policies of these other websites and service providers before submitting any information to them.

In some cases, however, You may need to contact us by phone to update Your Information.

 

We will use our commercially reasonable efforts to accommodate your request in a timely manner. We may keep a record of all information that is deleted and may determine what information may be deleted. For example, if we are required to maintain certain information for regulatory purposes, we may be prevented from deleting that information. In addition, even if We remove Your Information from our “live” database, it may still be stored in other databases (including those maintained for archival purposes). We are not responsible for the removal of information about you from third-party databases.

 

Children’s Privacy. The Site is not directed to minors and we do not knowingly collect information from individuals under the age of 18.
